Claims: Claims for damaged goods are
the responsibility of the carrier. Please INSPECT CARTONS BEFORE SIGNING A
DELIVERY RECEIPT OR BILL OF LADING .In the event of damage please mark it on the
bill of lading and email Earthflora immediately.
Payment: All orders can be prepaid by
credit card (Visa, Master Card, American Express, Discover ) or check in
advance.
Samples: Sample cuttings are available
upon request of most items shown for sale.
Plaster base: **Most Items will come
pre-potted in plaster with the exception of all outdoor products. These product
require cementing in either your own planter or the ground. Items that are too
fragile will come with a potting kit . The potting kit consists of a paper mache
container and plaster. Simply add water just enough to create a creamy mixture
to the plaster in a separate container such as a bucket. stir and pour contents
into the paper mache container provided and insert the stem of the palm into the
mixture while holding upright until it hardens, about 5 minutes or so.
Outdoor Shrubbery Installation Tips- It
is recommended that all outdoor items be cemented in a separate container such
as plastic nursery container or metal container such as a large coffee
can. Cement can be purchased at any local hardware store. Follow the directions
on the package for cement preparation.
To ensure proper anchoring and security
against forces of nature and man consider the following installation method
below...
Most or our polyblend outdoor shrubbery
have serrated stems which grip the cement and keep the plant firmly anchored. To
further insure a secure grip, heavy gauge wire can be twisted around the stem 3
to 4 inches below first branching to help grip cement. For larger plants, a nail
or spike can be driven through the stem to serve the same
purpose.
Consider the following before installing
our Polyblend Outdoor Shrubbery...
1. The size of the plant--larger plants
should be placed in larger containers.
2. Will wind conditions be an important
factor? If so, a larger container and more cement is necessary.
3. Is landscape area a high theft
location? If so, a larger and heavier container and more cement is
necessary.
Product Disclaimer: Actual height of
foliage is determined by how it is shaped. We measure our foliage from the very
bottom of its base to the very top of the foliage extended straight up in the
air.
**Most Items will come pre-potted in plaster
with the exception of all outdoor products. These products require cementing in
either your own planter or the ground. Some assembly may be required on certain
palm trees such as plugging leaves into stem and shaping leaves out to your
liking. Almost all items will require some shaping to a degree due to shipping
constraints. Shaping is simply bending the leaves and stems to achieve a natural

approximates and contingent on how you shape and pot the item. Please feel

Our Polyblend Outdoor Items are suitable
for outdoor use--all other products
ARE NOT MADE FOR OUTDOOR USE. We will not be held responsible for misuse
of our product.
Assembly: Due to packaging constraints some of
our products may require shaping. Shaping of most products simply requires
twisting and bending of stems to achieve a natural look. Some palm trees will
require insertion of palm fronds into the stem receiver slots and bending down
of palm fronds. If assistance is needed please feel free to email us. We
would be happy to guide you with step by step instructions on achieving a
natural and appealing look.
Top dressing: Moss is included with all
items sold except outdoor items. It is recommended that cedar chips, mulch,
dirt, or stone be used as a top dressing for outdoor items.
Planters: All planters are sold
separately. Some planters are shown for display purposes only. The planters we
sell are pictured in the planter section. Simply click on the planter navigation
bar to your left to view our selection.
Fire Retardant Foliage: Earthflora
offers an inherant fire retardant product. We impregnate the necessary fire
retardant directly into the fabric and polyethylene branch components prior to
printing and Injection molding. Our fire retardant system will not dissipate,
wash off, drip off, or leave a messy or oily film. It meets all the National
Fire Prevention association 701 tests for non-flammability plus the ASTM E84-95,
Standard Test Methods for Surface burning Characteristics of Building Materials.
This test method is also published under the following designations: ANSI 2.5,
NFPA 255, UBC 8-1 (42-1). UL 73.

Returns:
Complete Customer Satisfaction is our number one priority. If you are not
completely happy with your order please email returns@earthflora.com or call us toll
free at (877)252-1675. We will give you instructions on making the product work
or directions on returning the product back to us.
Please do not ship your merchandise to the address
on the invoice. Any returns shipped to the address on the invoice will be
charged our cost to ship the merchandise to our warehouse facility.
Returns must be made within 5 days upon receipt of the
product. You must obtain an authorization number and have this number labeled on
the outside of the box. Any return sent back without this number will be
refused. Unauthorized returns will
not be accepted nor credited. The product must be sent back in the
original condition it was received. Any alterations or manipulations made to the
product warrants our right to deny credit for the product returned. Credit will
be given for the merchandise only. Authorized returns will be credited less a
restocking fee of 20% of your return. Return shipping charges are the buyers'
responsibility. Please understand the restocking fee covers lost shipping
charges to you, processing, packaging & handling of the order & return.
Any disputes made
with a credit card without trying to resolve matters first with Earthflora Inc.
will be charged a 10% service fee in addition to the 20% restocking fee for the
return. Unpaid shipping & Duty charges will be immediately charged to your
credit card.
*** Christmas
Trees are not returnable after December 10th 2010.
***Any order refused at the time of delivery without
damages will be charged for shipping charges back to Earthflora. Refusal of any
order at the time of delivery will not be credited and shipping charges back to
Earthflora will be immediately charged . Furthermore, arrangements will have to
be made for pick up or re-delivery by the buyer. Storage fees of $25.00 per day
may be assessed until the buyer's merchandise is removed. Earthflora will not
hold products over 30 days from the date of refusal. The buyer's refusal to
pick up his/her merchandise within 30 days of refusal warrants Earthflora.Inc.
the right to dispose of and release any legal claim made against Earthflora
Inc. and its affiliates from disposal of the order.
Custom Made Items Disclaimer: All items made on wood, aloe, or texturized
pipe are custom made items (items made per order). We work hard to specially
design and build these items by hand. Please be advised these items are
non-returnable and can not be cancelled once the order is in process. We
appreciate your understanding and hope that we can exceed your expectations when
ordering such fine products.
Other Non
returnable/NONCANCELABLE items: Boxwood hedges, boxwood animal topiaries, preserved items,
fire retardant items, items that are especially set in weighted bases for you.
*Any
International order cannot be returned or canceled once it has been
placed.

Orders
are deemed to have taken place at our location in Westlake,Ohio. All legal issues and upholding of all of
Earthflora Inc. Ordering, Sales and Return Agreement, Conditions and Policies
are under the jurisdiction of Ohio Law, Cuyahoga County .
The
Agreement and the relationship between customer and Earthflora Inc. shall be
governed by the laws of the state of Ohio without regard to its conflict of law
provisions. Customer and Earthflora Inc. agree to submit to the personal and
exclusive jurisdiction of the Superior Court of the State of Ohio for Cuyahoga
County or the United States District Court for the State of Ohio. Earthflora's
failure to exercise or enforce any right or provision of the Agreement shall not
constitute a waiver of such right or provision. If any provision of the
Agreement is found by a court of competent jurisdiction to be invalid, the
parties nevertheless agree that the court should endeavor to give effect to the
parties intentions as reflected in the provision and agree that the other
provisions of the Agreement remain in full force and effect. The person ordering
from Earthflora Inc. agrees that regardless of any statute or law to the
contrary, any claim or cause of action arising out of or related to purchasing
of product from Earthflora Inc. must be filed within thirty days after such
claim or cause of action arose or be forever barred.
The section
titles in the Agreement are for convenience only and have no legal or
contractual effect.
Earthflora Inc. reserves the right, in its sole
discretion, in the future, to change, modify, add or remove all or part of
Earthflora Inc. ordering, sales, return, conditions and policies at any time.
